Terrified descents down elevator shafts are not the exclusive preserve of Hollywood thrillers; they really do happen. For example, a 2009 lift accident at London's iconic Tower Bridge resulted in six tourists suffering injury, with at least one indicating that he would be contacting a personal injury solicitor in order to make a holiday claim for the injuries he sustained in the incident.
Fortunately, it is usually possible to make no win, no fee claims for this kind of lift incident. A personal injury solicitor from one of the UK's largest firms says that the key is in "establishing the history of the lift itself and whether it was inspected regularly and maintained properly."
However, in some cases proof of liability is so obvious that it is unnecessary to spend time gathering evidence. One 2009 incident, in which a 67-year-old blind man fell ten floors down an empty shaft after walking through a faulty lift door, is a good example of this.
David Percecman, a US-based personal injury solicitor comments, "Based on several news report, in my opinion, there appears to be little doubt that the accident and wrongful death is the fault of building management and possibly even the company that services the elevators in the dead man's building.
"Most elevator accidents issue for the courts, usually comes down to proving that the injury to the plaintiff was a result of negligence on the part of the people responsible for the care and upkeep of the elevator.
"But in this case, should [the victim's] family seek legal redress for wrongful death, there may be no need to prove negligence. The court uses a doctrine known by its Latin name, 'Res ipsa loquitor,' the act speaks for itself, which in this case seems obvious. A blind tenant waiting for an elevator, the elevator doors open, but the elevator cab isn't there and the man falls down the elevator shaft to his death. The act speaks for itself."
