Celebrity chefs, duty of care and personal injury solicitors


In 2008, a news story revealed 6 million UK viewers of cookery programmes had caused damage to themselves or their kitchen by trying to cook along. This was later shown to be a mischievous PR release for a home insurance company - but the idea does contain a kernel of interest for personal injury solicitors.

The figures cited in the release included reports of people suffering cases of personal injury from cooking techniques such as deep frying and skewering, with - respectively - 48 percent and 27 percent of people interviewed reporting burns, scrapes and cuts.

These are, in most cases, fairly minor examples of accident injury, and unlikely to lead to someone making a compensation claim. However, in a restaurant kitchen, it might well be possible to make a work accident claim if a more serious accident injury were to result from insufficient training having been given to one of the chef's staff. What level of care, then, do TV chefs owe their viewers?

Tony Tobin, a TV chef, said, "It's great to see that kitchens across the country are becoming hubs of creative cookery - fuelling a passion for food and the growth of the dinner party. However, all celebrity chefs have had years of training and people at home must remember this when attempting to recreate any dishes they see on TV.

"Make sure you're familiar with the basics before trying out any complicated culinary techniques and prepare your kitchen before starting. A cluttered kitchen is a dangerous kitchen."

While that warning suggests that TV chefs do feel a duty of care toward the people following their recipes, their relationship with their viewers is not the same as that between employer and worker. Perhaps as a result of this, there is no record of a TV chef's instructions leading to serious personal injury claims, not even from Anthony Worrall Thompson's recommendation of poisonous leaves for a salad.
