Personal injury solicitors, barristers and PIBA


Although most injured people's experience of the legal system will begin with meeting a personal injury solicitor, it is possible that a contested claim will require the services of a barrister at some point. As with solicitors, there is a specialist association for those barristers working in this area: PIBA.

PIBA stands for Personal Injury Barristers Association, and the body lists its aims as being:

  • To provide a forum for discussion on matters of common concern and interest to our members;
  • To ascertain and represent the views of members on matters affecting their professional interests; and
  • To further the study, understanding and development of the law relating to personal injuries

The suspicion that these aims resonate strongly with those of APIL, the Association of Personal Injury Lawyers, is confirmed by the existence of a model document drawn up by the two organisations to create an example of best practice in conditional fee arrangements (better known as the no win, no fee model).

PIBA offers its members access to conferences, seminars and meetings, alongside an area within their website where online versions of this process of information exchange may occur.

While it is possible, following a 2004 change in the law, for a person who has suffered an accident injury to contact certain barristers directly, it is still the case that most personal injury compensation claims are handled by solicitors. Many of these never need to go to court, being settled before that is necessary.
