There is evidence to suggest that UK personal injury solicitors may be dealing with an increased number of claims for road traffic accidents involving foreign lorries.
Data from accident management company Accident Exchange indicates that the number of collisions involving foreign lorries rose 10% over the most recently reported 12-month period.
The majority of these accidents happen on motorways, with the M25 the national blackspot, accounting for 25% of all motorway accidents involving foreign heavy goods vehicles.
According to the accident management company, the practice of "sideswiping" is to blame for the majority of these motorway incidents. Sideswiping occurs when an HGV pulls out to overtake unaware that another vehicle is on their blind side; incidents that often result in catastrophic consequences.
Statistics show that one in ten sideswipes involving a foreign, left-hand drive lorry results in the sideswiped vehicle being written off. Tragically, 30 people die each year in these incidents.
And, worryingly, many motorists (32%) report that they have been unable to pursue compensation for their sideswiping-related injuries.
A spokesperson with Customer Services at Accident Exchange, explains some of the difficulties claimants and their personal injury solicitors face, "Non-existing policies, difficulty contacting foreign insurance companies, drivers pulling off without leaving details: reasons cited for why motorists are likely to be unsuccessful in recovering damages from foreign-registered HGVs."
This is far from the first time the issue has raised its ugly head. In December 2007 the Department for Transport distributed 200,000 Fresnel lenses to foreign lorries entering the UK. It was hoped that these would help reduce the number of sideswiping accidents caused by lorries failing to see vehicles on their blindside. Although to begin with this did seem to help, accidents being reduced for the first three months, the number of accidents soon returned to pre-Fresnel levels.
