Finding a personal injury solicitor in the UK, to help you claim work accident compensation, is fairly easy. There are many advertisements aired on the TV and a quick internet search for "no win, no fee lawyer" will give you a seemingly unending list of professionals and firms who may be able to help you with your claim.
But, if you were injured in certain countries, whose health and safety laws are not so stringent and where access to justice is not available to the masses, then an accident at work can turn into a financial disaster for an industrial accident victim.
In June 2010, eight Indian industrialists were convicted of criminal negligence for their part in the Bhopal industrial accident which caused devastating loss of life and environmental damage when the Union Carbide pesticide plant sustained a major gas leak in 1984.
The industrial accident caused the deaths of more than 8,000 people and left thousands more with horrific personal injuries and health problems as a result of the toxic gas leak.
It is reported that a total compensation fund was made of US$470 million in full and final settlement of its civil and criminal liability for the industrial injuries.
Many families were given interim relief if anyone in their family had been killed or injured by the gas leak.
Personal injury and death compensation claimants, having been categorised by a doctor, were expected to prove to courts "beyond reasonable doubt" that the injury or death was caused directly by exposure to the toxic gases released on December 2nd and 3rd 1984 at the Union Carbide site.
In 1992 just under half (44%) of the claimants still had not been examined by doctors.
By 2007, 1,029, 517 cases had been registered and ruled upon. Of those individual claims for compensation, 574,304 received compensation and 455,213 were rejected.
It was reported that due to the meagreness of the compensation sums paid out, and the refusal to grant interest payments on the compensation amounts to the victims, it was estimated that a sum of around Rs 10 billion (approximately US$212,365,000 as at June 2010) would be left in the compensation fund once all the claims had been paid out.
