For a close-up magician, even the slightest work accident injury can have a profound impact on his or her ability to command the credulity of an audience, whether by illusion, deception or plain old-fashioned indecipherable magic – in the event another party is found liable for this, a personal injury solicitor may be able to assist with a claim for compensation.
2008 magician's accident claim
In 2008 a magician from London received a significant settlement of work injury compensation after fracturing his finger while working as part of a "Chamber of Horrors" show at Madame Tussauds.
Following resolution of his accident claim, the claimant's personal injury solicitor explained why injury litigation was necessary. "It may just be a broken finger, but to a close-up magician it is draconian. It was the loss of his earnings from other sources which contributed to his damages," she said.
She also said that although entertainment professionals' "claims are notoriously difficult to pursue, particularly when they are employed on a temporary contract. Where performers are members of a trade union, they may have legal assistance to enable them to pursue claims for personal injury. However, many performers do not have the benefit of union support or may sustain injury in circumstances outside the workplace."
2011 magician's medical negligence claim
In 2011 a magician suffered a severed tendon as a result of his hand being cut by a smashed cup.
However, doctors initially failed to diagnose the injury, which caused it to worsen and reduced the magician's ability to perform close-up magic. As a result of this the claimant's legal team successfully secured an injury compensation settlement of £15,000.
The magician commented, "Suffering even the slightest hand impairment is an absolute nightmare for any magician. In my case, it happened at a critical time in my career, although I had been able to continue working albeit with a fair bit of discomfort... I am now returned to full flexibility and audience feedback suggests the injury isn't obvious."
