Many insurance policies refuse to compensate people who are hurt by a so-called act of God' but a good personal injury solicitor may still be able to obtain a damages settlement where an incident involving nature has occurred if it can be proved that some person or organisation could have taken more action to prevent harm being caused to an innocent person.
For example, highway authorities and railway track maintenance management still have some legal responsibility for the condition of the verges, hedges, trees, rocks or other natural habitat around the transport routes and to keep the carriageways or rail lines free from potentially-dangerous obstructions.
In July 2011, rail accident investigators decided that Network Rail, which repairs and maintains the UK railway infrastructure, should have done more to stop a boulder from falling onto the line in Scotland. A long-distance passenger train was derailed when it hit the rock and fell on the embankment.
Although no one suffered a passenger injury in the crash which happened during the previous June, recommendations were made to improve the safety regime alongside the track and so reduce the possible hazard of other rock falls.
It was suggested that regular inspections of steep slopes above the tracks where they run in cuttings should be carried out so that action could be taken to remove debris or vegetation and that erosion of soil would not lead to a landslip.
Although, generally, the slopes of earth mounds above road cuttings are at a less severe angle than those on railways, the same principle applies to roads where falling trees or their limbs, loose earth and other natural debris can cause quite a severe hazard to passing traffic.
Compared with a train, motorists have a better chance of avoiding an object fallen into the road but the damage caused in a consequent road traffic accident could be just as serious, if not more so.
