Apprenticeships can provide a great way for young workers to start out in an industry. However, due to their lack of experience, apprentices are at greater risk of suffering a work accident and so adequate training and supervision must be put in place to prevent the worker from requiring the services of a personal injury solicitor for an accident in the workplace.
In December 2006, a young apprentice plumber was killed after being suffocated by a pile of 20 MDF boards while at work. The 18-year-old was working alone when he was found by a work colleague crushed against a wall by half a ton of the board.
Despite resuscitation at the scene by paramedics, the worker was pronounced dead shortly after at Aberdeen Royal Infirmary. A post-mortem examination showed that the teenager had died from "traumatic asphyxia, whereby his chest and neck were compressed by a considerable weight of fibreboard."
In April 2010, the case was taken to court and his employers were tried for failing to ensure the health, safety and welfare of his employees. They were also accused of failing to take reasonable measures to reduce risks to health and safety and leaving unsecured MDF sheets propped against the wall.
The outcome of the case was not immediately reported nor the compensation claim amount disclosed, but it's likely that a sizeable sum would have been awarded to the deceased's relatives if the worker's employers were found to be negligent.
Employers have a responsibility to ensure the welfare of their employees. Apprentices should be adequately trained in all aspects of their job to ensure that the risk of injury is reduced. If the worker had not been working alone, help could have been found sooner and it's possible that the case would have had a less tragic outcome.
