Personal injury sufferers should not be plagued by cold calls

Solicitors who work on personal injury cases should not engage in cold-calling. That is the opinion of the government and of several professional bodies.

APIL, the Association of Personal Injury Lawyers, states, "No APIL member shall personally, or through a representative, directly contact a potential client (except through permitted advertising), where there has been no request for such contact (cold calling')." It is highly advisable to choose solicitors who are members of APIL; cold-calling, therefore, should work as a warning sign about the company doing so.

The Department of Justice and the Solicitors Regulation Authority agree with APIL on this. In fact, attention is drawn to that fact in a 2008 document published by the Department, 'Impact of Regulation - One Year Assessment', where they state that emphasising the identical approach has been part of the year's work.

The same document draws attention to their activities that attack any unscrupulous attempts to weaken the definition of 'cold calling'. A new Guidance Note has been issued that states:

"There have been a number of questions on what is meant by cold calling in person. The term should need little explanation. Any face to face contact initiated by the claims management businesses is cold calling in person. This includes knocking on doors and approaching people in the street or shopping centres, including what is known as 'clipboarding'. It is permissible to have a booth or stand in a shopping centre or exhibition as long as the people manning it do not attempt to make the first contact."
