Personal injury future under review

In May of 2009 it was announced that Court of Appeal judge Lord Justice Jackson would be publishing a 650-page, 63-chapter report into the civil justice system, something that is likely to have a profound effect on the future of UK personal injury law.

Although the report is not due to be ready for public viewing until December 2009, it is anticipated that there will be some radical changes. Justice Jackson indicated just how controversial he expects his report to be when he compared his work to that of the Roman Emperor Justinian, who, he said, "rewrote the rules for the entire new Holy Roman Empire in 14 months".

The current personal injury principle of having the loser pay costs is just one of the many aspects of the existing litigation process that is perceived to be under threat. Despite it having reigned for hundreds of years, Lord Justice Jackson says that "loser pays is not the only option".

He has also suggested curbing success fees, which until now have been one of the fundamentals of the no win, no fee system that has been so successful in providing access to justice for all. He blames these success fees for "a costs war", which he claims has crippled the NHS. He also suggested that he might bring an end to the expectation that successful claimants would receive 100% compensation.

However, he is likely to face stern opposition from personal injury solicitors who believe that "100 per cent retention of personal injury damages is now an established principle, from which there should be no retreat. Damages for personal injuries, unlike damages in respect of other matters, are sacrosanct."
