In July 2010, a very sad case was reported in the press which involved a home owner, a postman and personal injury lawyers.
The outline of the case was this:
A claim for work accident compensation went to court after a postman alleged he was startled by a growling dog on a property and when he turned to flee, he tripped on uneven pathway leading out of the garden.
The post worker suffered a torn knee ligament, which required surgery, and although according to doctors he recovered well, he was forced to retire from the post service. He took a job as a handyman, but his earning potential was severely curtailed.
He instructed personal injury lawyers to make a claim for work accident compensation on his behalf. In most cases, if a homeowner is deemed to have been liable for the personal injuries caused to someone while they were on their property, their home insurance will have a portion of cover specifically for public liability and any compensation will be paid by the insurer.
However, the homeowner found to be responsible for the postman's injuries had not kept up the payments on her home insurance.
It was alleged that several letters from the postman's personal injury solicitors had been ignored and eventually the case went to court without the homeowner being involved. The court ruled that the postman should be awarded compensation.
As the homeowner did not have insurance to cover the compensation costs it is likely that she would be forced to pay the compensation and the legal fees out of her own pocket.
At the time, newspapers reported conflicting evidence given by the homeowner regarding the accident which, had she been in court and adequately represented by her own solicitors, may have swayed the judge's decision, however as it stood it looked exceedingly likely that she would have to sell her house to pay the damages.
