Relatives of the marine trainer killed by an orca whale at Florida's SeaWorld in 2010 could employ the services of a personal injury lawyer to pursue a compensation claim for the worker's death.
A detailed investigation into the female trainer's circumstances found that the woman's death could have been avoided if the Florida theme park had minimised employees' exposure to dangerous marine animals.
The incident occurred in February 2010 when the trainer was in the pool with one of the male killer whales. The trainer was dragged under water by the whale and suffered major trauma which proved fatal.
The American Occupational Safety and Health Association (OSHA) found that bosses at Sea World failed to create a safe working environment for their employees and violated three safety rules. This included exposing its employees to hazards when interacting with killer whales, failing to install a stairway railing system on one side of a stadium stage and failing to put weatherproof enclosures over outdoor electrical receptacles.
The park was fined £50,000 for the employee's death and workers are no longer allowed to swim with the killer whales.
Hitting back at the allegations made against them, SeaWorld said, "OSHA's allegations in this citation are unsupported by any evidence or precedent and reflect a fundamental lack of understanding of the safety requirements associated with marine mammal care."
It has not been reported whether the trainer's family have made a compensation claim against the park for her death but a successful claim could be made following the OSHA's verdict.
