The make up of a personal injury compensation award

When a personal injury damages award amount hits the headlines it is sometimes hard to understand how a court has arrived at the figure, but in August 2009, an award was made to an ex-soldier that was explained in detail by the report.

Why the claim was made
A statement submitted by the claimant's personal injury lawyers said that the 22-year-old had suffered "high tone sensorineural hearing loss in his left ear together with left-sided tinnitus," which had occurred after an army training exercise in 2004, when he was just 17.

During the live firing exercise, the trainee soldier was ordered to give up his military issue ear defenders so that the scenario would seem "battle realistic". He was advised that once he had crawled to a trench he would find disposable ear-plugs to use, but none were available. As he tried to speak to an instructor, colleagues began to fire live rounds and thunder flashes were set off.

The noise induced hearing loss he suffered as a result of the exercise effectively ended the recruit's army career and he was discharged on medical grounds in 2007. His claim for compensation was brought on the grounds of negligence, personal injury, and loss and damage. The Ministry of Defence admitted liability.

What the court awarded
The judge at Newcastle County Court awarded the claimant £324,941. This figure included damages for loss of congenial employment, disadvantage on the labour market due to his impaired hearing ability, and loss of future earnings.

The man had come from a military background and had planned to become a pilot. The judge stated that he was satisfied it had been the recruit's intention to have a full 22 years in the armed forces and acknowledged the probability that the young soldier would have been promoted.
