In July 2010 arguments broke out in the American press about a mass "document dump" which appeared on WikiLeaks, an internet site which published confidential and potentially controversial documents, when a former defence lawyer for the US Navy went on record saying that the appearance of such documents on WikiLeaks was "a gold mine" for solicitors who wished to instigate personal injury compensation claims against war-zone contractors.
The civil litigator, a partner in a firm which represented aerospace and defence contractors, said, "I see this database as a real resource for U.S. plaintiffs' lawyers who are already trolling for potential clients anyone who is named as having been injured, service member families who happen to reside in their state, etcetera.
"To a personal injury plaintiffs' lawyer, those are all potential clients in a tort suit against a contractor. So, for the ambulance chasers of the battlefield, the WikiLeaks database is a goldmine," she added.
However, a founding partner of a Houston law firm which specialised in personal injury and civil litigation said, "I resent the implication that this leaked information provides any source of clients for plaintiff lawyers."
He added that although he represented both service men and women, and contractors, all claimants sought the legal advice of the firm because of their reputation.
"I don't solicit clients, "he said.
Sadly, rather like the compensation culture whingers it appears that certain sectors of American society believe that members of the US armed services should not make claims when they suffer personal injuries in the course of their employment as the law firm's website states:
"It is not unpatriotic to seek redress against corporations that have put their profits and convenience above their responsibility to our fighting men and women, their civilian contract employees or foreign citizens."
The WikLeaks site aims to protect those who have information and documents which "out" dangerous practices and underhand dealings. Their website says:" WikiLeaks is a multi-jurisdictional public service designed to protect whistleblowers, journalists and activists who have sensitive materials to communicate to the public.
WikiLeaks and personal injury compensation claims
Whether the leaking of documents into the public domain is a good or bad thing probably depends on how the said documents affect an individual, but as personal injury solicitors we believe that any legal process of uncovering negligence which has caused harm is necessary and people should be obligated to do so. A site like WikiLeaks may help people to come forward to show where dangerous practices are being ordered and where unscrupulous officials may be insisting on cover-ups.
