The pursuit of evidence in personal injury compensation claims

Whether a claimant will receive personal injury compensation or not depends largely on whether a successful prosecution is brought against the alleged perpetrator of the accident and whether investigation into the accident finds uncompromising evidence to substantiate negligence on their behalf.

A TV programme on accident investigation showed the lengths to which investigators will go to in order to establish fault in an accident case. One incident in question involved a car which had hit and injured a cyclist.

The car accident had occurred at night and though the cyclist maintained he had been wearing high-visibility clothing and had been using bicycle lights, the driver of the car alleged that he had not been able to see the cyclist and so, was not at fault.

The programme makers followed the investigation teams as they attempted to piece together evidence which would demonstrate whether the parties to the accident were telling the truth.

Firstly, they took the remnants of the cyclist's smashed rear light and attempted to determine whether it had been working at the time of the accident. The light had been badly damaged in the car accident and an electrics specialist carried out extensive tests on the components.

Although the investigator could determine that the batteries had charge and the light bulbs were all working, some of the connecting terminals were damaged in a way that may have occurred before the accident and so, unfortunately, the tests proved inconclusive.

As prosecuting solicitors would have to rely on further evidence, investigators then collected the outfit the cyclist had been wearing, including his back pack, and took photographs to see if there was any reflective material in the make-up of the clothing.

After taking photographs in a reduced light situation, to mimic the conditions in the street where the accident occurred, the investigators concluded that the clothing had been slightly reflective, but the back pack had been made of several areas of bright reflective material which would have been illuminated by the driver's car headlights.
