Occasionally individuals suffer from a personal injury for months, or even years, without being aware that the medical problem they are suffering from was caused by another individual's negligence.
However, upon discovery of the cause of their injury they might decide to contact a personal injury claim solicitor.
An example of cases in which this sometimes occurs is when foreign objects are left in someone's body after a medical procedure.
On most occasions problems such as these are noticed and rectified relatively quickly, since the victim typically will become ill or be in some degree of discomfort which leads to an examination.
Yet there are some cases which last an extended period of time due to medical staff incorrectly examining the patient's complaint, or diagnosing it as a separate health problem unconnected with their recent hospital treatment.
One man, who had a steroid injection in his arm in 2007 for a sports injury he had sustained, was left with a swollen and painful joint for two years. Returning to his GP several times he was eventually diagnosed with tennis elbow – but in fact a broken needle had been left in his arm.
When this was discovered in 2009, he underwent emergency surgery to have the piece of hypodermic needle removed. He was left with a 6 inch scar on his arm and reportedly still suffers pain in his arm despite the foreign object having been removed.
The poor training or medical negligence of the staff who originally carried out the steroid injection is to blame for the man's stress and pain, but the failure of other medical professionals to carry out a thorough investigation into his symptoms is also largely responsible.
The victim decided to pursue legal action against the medical centres which performed injections in his arm between 2007 and 2009. In May 2011 the case was still ongoing.
Hospital and surgery staff should properly examine patients whose health problems are not improving or have suddenly declined despite treatment, since this may be a good indication that the original diagnosis was incorrect.
Diagnosing the symptoms without further investigation could seriously reduce someone's quality of life, or even result in their death.
