Snow and ice accidents could result in a personal injury claim for compensation

Snow is fun to play with and looks lovely from a distance, but when it turns to ice it becomes a much more menacing prospect. The fear of slips and falls on pavements resembling skating rinks and the possible consequence of a personal injury claim becomes a pertinent apprehension.

In places which regularly experience snow, local authorities are organised to keep public paths and roads open, drivers are prepared with snow chains and shovels, and residents are used to wearing appropriate clothes and footwear to keep comfortable and minimise harm to themselves.

In the UK, although councils and the Highways Agency do whatever they can to keep roads open, many householders and businesses clear the paving around their homes, shops or offices in order to help those walking past, however, they could be laying themselves open to a personal injury claim if a passer-by should happen to fall and hurt himself.

The reason this supposed good deed could backfire on the person who cleared the ice is that, having taken responsibility for removing the hazard, the condition of the paving could lull a passer-by into a false sense of security, believing the area was completely safe and if this turned out not to be the case then the clearer could be accused of negligence.

A claimant would need to show the clearer had acted maliciously or carelessly which could be difficult to prove. On your own land you owe visitors a duty of care so if you know your path is slippery you should try to keep it safe for those with legitimate rights to enter your property, such as the postman.

Accidents which are the fault of action or negligence can be the subject of compensation claims by victims who have been injured or otherwise suffered.

In some cases, there can be a dispute about whether the victim was partly liable for their own injury and then it is particularly useful to have the services of an experienced personal injury solicitor to advise on the circumstances and possible progress of a claim.
