Every now and then a news story emerges about a road traffic accident for which no one can be found liable, which means that the victim cannot make a personal injury claim.
During poor weather in the winter some incidents occur when weather-worn trees fall into roads, crushing any car which happens to be in the wrong place at the wrong time.

Although these types of events are as unfortunate as any other accident on Britain's highways, incidents such as these are often viewed as unforeseeable and therefore no one will be found liable since no one caused the victim's injury or death, and no one could have reasonably predicted its occurrence in order to prevent it.
Occasionally however, a council or other authority may be found liable for a seemingly natural event, due to where the tree is stood.
For example, if a tree growing on council-owned land is rotting or has another illness which means that during windy weather, it, or one of its branches, is at risk of falling, then the authority should take action and call in a tree surgeon to make the tree safe.
Ignoring a tree which is exhibiting signs of weakness, could result in a pedestrian or motorist getting badly injured. Tree surgeons will cut any limbs which are becoming dangerous, or may even cut down a whole tree if necessary.
