Personal injury compensation for non-fault ladder accidents
01/04/2011

Some ladder injuries are caused because employers have not given a worker enough training or personal protective clothing and equipment, and others might occur when a ladder is faulty. However, not all ladder injuries are work-related or result in a product liability case – some casualties can't even claim for simple personal injury compensation.

These cases, in which no win, no fee lawyers cannot help the claimant, are those which involve an at-fault individual.

Legal action can only be taken against a person or a company if the personal injury victim suffered the accident through no fault of their own.

Someone else must be liable for the incident before a solicitor can make a case for a client.

For this reason it is always wise for an individual to observe all safety warnings on products so that they do not injure themselves in the first place.

Ladders are particularly dangerous for people who do not use them very often, because there are many different types.

If someone uses the wrong type of ladder for a certain job, the ladder could fail to keep the individual safe. For example, some ladders have hooks at the end for roof-work, so that the ladder is kept securely fixed in place.

Using a ladder without the special add-ons, or with the wrong add-ons for a job, could make a ladder less suitable for certain work and potentially unsafe.

Additionally, step-ladders and extendable ladders have a safety clip which stops the rungs from moving once the ladder is at the correct angle or at the correct length. A person who is not used to using ladders might not realise this, or may not push the clip properly, resulting in the ladder not being secure and them falling from it.

Furthermore, inexperienced individuals may not realise that ladders should not be placed on uneven surfaces and are likely to be affected by slippery or soft ground or flooring.

Personal injury compensation
Unfortunately, if you caused yourself injury by not reading safety warnings or ignoring them, you are not likely to be able to make a claim.

However, if you have suffered a ladder injury in a non-fault accident for which someone else's negligence is to blame, you may be eligible to make a compensation claim for your pain and suffering, and any loss of earnings.
