Compensation from a taser accident claim

The police in the UK perform a very valuable service to society and, for the most part, do a good job. However, sometimes they make mistakes or behave in a way that can be described as negligent or aggressive. In recent years, since police have routinely become equipped with taser guns, there have been a number of cases of members of the public being unfairly shot with tasers; in such cases those affected may be entitled to make a taser accident claim.

There is plenty of precedent for receiving compensation from a taser accident claim. In 2006 a man from Leeds became the first in the UK to be paid compensation for being unjustly tasered by police.

The man, a diabetic, had been travelling on a bus to visit friends for a post-work drink when he fell into a hypoglycaemic coma. Unresponsive as the bus pulled into a depot, the driver feared the man was a terrorist so called police, who upon arriving at the scene promptly discharged a 50,000 volt taser gun into the man. Indeed, it was only after he regained consciousness in the back of a secure police van that the man was able to notify police that he needed medical attention; had he not done this, it is conceivable that he may have died.

This is not the only case of police injustice with a taser gun. In 2010 Nottinghamshire police were referred to the Independent Police Complaints Commission (IPCC) after they accidentally shot a 14-year-old girl while apparently aiming at an "aggressive" 20-year-old man.

Police apologised for the incident and many commentators stated that it was possible the girl would attempt to claim compensation.

It is thought that normally, aside from the fleeting pain and long-term trauma caused by a taser, a healthy person would not expect to suffer any permanent damage caused by a taser shot. However, there is actually debate about whether this is the case. Amnesty International believes that in the USA alone over the past nine years nearly three-hundred-and-fifty people have died as a result of stun gun use. Those most at risk may include those with diabetes, those with weak hearts and those with other underlying health conditions.
