To reduce the instances of industrial deafness caused by exposure to loud or continual noise, and to hopefully prevent the necessity for workers to make a claim for personal injury compensation as a result, the Control of Noise at Work Regulations 2005 contain noise "action levels" as a guide for best practice within a noisy atmosphere.
Noise is measured in decibels (dB) and employers must ensure that levels of noise in their premises do not exceed certain measurements, as this could cause noise-induced hearing loss. If levels do exceed those quoted then preventative measures, or "action", must be implemented.
Action levels for noise prevention measures
Lower exposure action levels: Daily or weekly exposure of 80 dB – Peak sound pressure of 135 dB.
Upper exposure action levels: Daily or weekly exposure of 85 dB – Peak sound pressure of 140dB.
Exposure limit values which must not be exceeded: Daily or weekly exposure of 87 dB – Peak sound pressure of 140 dB.
In any work environment where noise exposure could be damaging, a risk assessment must be undertaken by a competent person to accurately determine whether the noise levels are actionable.
Under health and safety laws employers have a duty of care to protect the hearing of their employees and to prevent industrial deafness.
Where noise levels are between the lower and upper exposure action values employers must provide hearing protection if an employee asks for it.
Where noise levels exceed the upper exposure action levels employers must provide hearing protection for employers and ensure that it is used correctly. Also, in such areas, it must be identified as a hearing protection zone so that employees know that the wearing of hearing protection is compulsory in those areas.
