If you or a loved one has been hurt in an accident caused by another's negligence, it is your civil right to make a claim for personal injury compensation to reimburse you for loss of earnings, resultant expenses, loss of future earnings (if applicable) and, in certain cases, pain and suffering.
However, many people who have lost family members in an accident, be it a car accident or as a result of medical negligence perhaps, pursue a claim as they feel the person or persons' responsible should be held to account and they wish for lessons to be learned which may prevent a similar accident from occurring.
Personal injury compensation given away
In November 2010, an unusual case was reported upon where the mother of an 18-year-old woman, killed by a lorry driver who was found guilty of smoking cannabis and causing death by dangerous driving, was awarded car accident compensation, but who gave it away.
The young woman had been killed while standing on the hard shoulder. She had been exchanging insurance details with another driver after a collision which occurred in thick fog. The lorry driver, travelling at 60mph despite the road conditions, hit the young woman who died of her injuries.
The young woman's insurers felt sure the mother would seek car accident compensation from them and they told her she would be unable to make a claim as the woman had no dependents. However, the mother had no such intention to make a claim, and insisted as such, yet the insurers persisted and eventually offered the mother £1,000.
"I had not asked for compensation, but I told them my daughter was priceless and they had made her worthless. They then decided I was entitled to something for [her] pain and suffering. Again, I said I did not want anything as whatever was offered would be the final insult."
When the personal injury compensation award was finally received by the mother she decided to donate the money to a worthy cause and gave the sum to a soldier who had been horrifically wounded while serving in Afghanistan.
The mother said, "I would rather have had nothing. All I wanted then and all I want now, is [my daughter] back."
