Instead, the important point will usually be one of whether there has been appropriate surveillance that has reduced the risk of accident and personal injury to a reasonable level.
In fact, in Harris v Perry 2008 the Court of Appeal in Harris ruled that it was both unworkable and against the public interest for parents to keep children under constant watch. This is a decision which has been echoed and reinforced by various subsequent cases.
Exceptions
However, there are plenty of exceptions to the above principles. For example, in areas where there is a high level of risk, such as around swimming facilities or hazardous equipment, there is an obligation for schools, nurseries or other care providers to ensure that there is constant surveillance and supervision of all children and activities.
