Food poisoning, foreign objects and claims

Many cases of food poisoning are down to incorrect storage or preparation, but occasionally someone might become ill or sustain a personal injury after ingesting food which contains a foreign object.

Upon discovery of a foreign object in a food product, the person should take their complaint to the shop at which the food was bought, the manufacturer of the product, or the restaurant at which they are eating.

It is important not to remove the item from the food, even if it is partly eaten, and if the product is perishable the individual should freeze it to retain the evidence in as good a condition as possible.

Upon receipt of a complaint, a store will usually take a witness statement to gain as much information about the circumstances under which the potentially contaminated food was purchased.

Investigation is usually commenced by visually identifying the foreign object, or analysing the item in a more thorough fashion if it is difficult to classify.

As Braintree District Council explains on its website, sometimes, what appears to be "mouse droppings in white bread, turns out to be something quite safe [for example] a small amount of granary bread dough baked into the white loaf".

If the store finds that the object is present in error, is unhygienic and was mixed with the food in part of the manufacturing process, it will typically contact the company which produced the product and the relevant food safety agency for the area might also be contacted so that its opinion of the firm's health standards can be taken into account.

If it is discovered that the manufacturing company, store or restaurant is liable for the foreign object having been found in a product meant for consumption, the consumer might choose to proceed with a product liability or food poisoning compensation claim.
