FOIL defending against personal injury lawyers
The Association of Personal Injury Lawyers, or APIL, is a group that works to promote the rights of the personal injury solicitors and the plaintiffs whose cases they bring to court. A similar group exists for the insurance companies and defendants on the other side of a case, known as FOIL.
Founded in 1992, FOIL now has almost 2000 members. Its name stands for Federation of Insurance Lawyers, and, although its website states that it was not established in order to compete with APIL, it does say that APIL's successes have spurred on FOIL's achievements. These include making the organisation important enough to UK law to have been involved with the Civil Justice Council and the ongoing personal injury process reform.
While this could give the impression of a pair of large organisations in opposition to each other, the reality is one of dtente, as members of both APIL and FOIL can often use the size and expertise of these groups to achieve a settlement that is satisfactory to both sides. This can sometimes be done without the expense and stress of going to court.
This does mean it is worthwhile for any potential claimants to check that the personal injury solicitor they appoint is aware of APIL's work, and possibly to check whether the defendant will be using a lawyer associated with FOIL.
