Country walks could result in injuries caused by dangerous livestock

Country walks, with or without a dog, should be pleasurable most of the time but, unfortunately, there have been instances where a simple stroll has ended in injuries caused by dangerous livestock.

More than one dog-owner has ended up in hospital after cows took exception to what they saw as a risk to their calves which were also in the field. The size and number of a herd of cows are capable of inflicting serious harm if the animals are sufficiently agitated.

Farmers are obliged to keep footpaths and bridleways open across their land and not to allow bulls in fields to which the public has access but cows and horses are not regarded as normally dangerous so no particular warnings are built into the law for them. The exception is if an owner knows that a particular animal or animals could pose a risk, in which case a sign should be erected and precautions taken.

The Ramblers Association offers useful information regarding walkers and dangerous animals on its website.

The law regarding attacks by creatures which cause personal injury is governed by the Animals Act of 1971 but this covers only owners of animals which are of a dangerous species', such as bears and poisonous snakes, so for someone who has been hurt by an animal which is normally docile to succeed in a legal action for compensation they would have to prove there had been negligence in protecting the public and that it could have been foreseen an attack was possible.

However, those provisos should not prevent the victim of injuries caused by dangerous livestock from pursuing a damages claim if the case can be justified. A number of cases have been heard in the High Court and compensation awarded in many of them.

Farmers and others who are responsible for animals likely to come into conflict with the public are advised to have liability insurance to cover them for the eventuality of a personal injury case being brought against them.
