An interesting compensation claim case came to light in 2009, from the US, after an accident involving cyclists and a car occurred in November 2008.
The accident occurred in Pima County, Arizona at an annual bike race though the town of Tucson. A car, driven by a 91-year-old male driver, mistakenly drove into the path of the cyclists, severely injuring a number of them and leaving at least one with extensive brain injury.
At first, all interest focussed on the vehicle driver who left the scene of the car accident, but once the driver handed himself into the police, it became clear that the case would not end there.
In June 2009 the driver filed a compensation claim against Pima County, seeking $58 million in damages which he alleged was not for himself but for the cyclists he injured.
His claimed that the county had been grossly negligent and reckless in its handling of the bicycle race and that therefore, he was not fully liable for the accident. Reports in the American press alleged that the police officer directing traffic at the intersection where the accident occurred was dealing with another motorist at the time of the collision and, presumably, the 91-year-old driver felt he was not at fault as there were insufficient directions supplied for him to navigate local roads safely and to avoid the cyclists.
Significantly, the family of the most seriously hurt cyclist also made a compensation claim against Pima County's Sheriff, seeking $32 million in damages.
