Bonfire Night is meant to be an evening of fun and large community events can bring everyone together in one place to watch fireworks and enjoy each other's company.
Nevertheless, every year, despite the warnings, many people suffer burn injuries from bonfires or fireworks because they behave recklessly and ignore safety labels and common sense.
Most of the time it is the people who are negligent of the safety rules who get hurt, and in these cases it is unlikely that a compensation claim would be successful since they themselves would be seen as liable for the accident which caused them harm.
However, if a minor, who, it is deemed by the court, cannot be held responsible for their actions, sustained a personal injury while in the presence of a supervising adult, then potentially that adult could be seen as liable since they failed to halt any unsafe behaviour.
Furthermore, if an adult's directly negligent behaviour causes someone a personal injury then the victim of that reckless behaviour could take legal action against them for their pain and any resulting loss of earnings.
Ideally, any at-home fireworks or bonfires, similarly to community displays, will be undertaken with caution and only after having read the safety warnings and exercising common sense.
For example, fireworks which are labelled for use in a very large open space should not be let off in a small garden. Likewise, a bonfire should only be built far from trees, sheds and fences to stop it spreading.
Directgov provide further bonfire safety tips and firework safety tips to help people avoid personal injuries or property damage and make the night more enjoyable.
