Helmets help avoid brain injury compensation after winter sports accidents

A ski-ing or snowboarding holiday accident may result in brain injury compensation if it can be proved the actions or neglect by some person or organisation led to the incident and subsequent head injury of the victim.

The circumstances of winter sports accidents – slippery snow and ice linked to speed and momentum of the people involved – mean that injury is usually serious and often involves the head or spine.

Training, experience, protective clothing and equipment can all help to mitigate the potential of harm for a skier or snowboarder in the event of an accident and the most important of these is a helmet.

Research by the University of Innsbruck's department of sports science in Austria, published in February 2011 has highlighted the effectiveness of wearing a helmet.

With traumatic brain injury being the leading cause of death in winter sports, the fact that the head injury rate for helmet-wearing adults was reduced by 35% and for children under 13 by 59% makes a compelling argument for the importance of head protection.

According to a survey by travel services company Essential Travel, around 40% of skiers do not wear helmets, although three-quarters of respondents said they had suffered a skiing accident.

The business has been working with the brain injury charity, Headway, to promote the use of helmets for winter sports and thus reduce the seriousness of injuries resulting from accidents on the mountains.

Chief executive of Headway Peter McCabe said over the past few years the number of skiers and snowboarders wearing helmets appeared to have risen.

"However, it's vital that we continue to raise awareness among winter sports fans of just how easy it is to sustain a serious injury on the slopes. This campaign will help us do just that, while reminding people of the need to ensure they seek medical attention immediately following a blow to the head."

Many skiing accidents are caused by the inexperience or carelessness of the victim himself but often other people are involved such as in a collision or if there is an issue over maintenance of slopes or equipment.

In those situations, the question of liability for compensation for the injury victim may arise and where disability, or a brain or spine condition is involved is likely to be a long-term medical problem, it is particularly important that suitable recompense for pain, suffering and loss of earnings is paid.
