Personal injury solicitors, claimants and the JSB guidelines

It is a safe bet to say that every good personal injury solicitor in the UK has a copy of JSB's Guidelines for the Assessment of General Damages in Personal Injury Cases.

The guide was first published in 1992 and since then has been regularly updated and is seen as the definitive guide for determining settlements for payouts in accident injury litigation.

Although, strictly speaking, the guide applies only to claims in England and Wales, it is also a document that should be familiar to every personal injury solicitor working in Scotland as well.

In short, although the guide recognises that every individual claimant is different and that injury awards should reflect these differences, it also understands the need to ensure that there is a large degree of consistency in the determination of no win, no fee compensation payouts.

As such, it can be said that its recommendations for the settlement of particular injuries represent this consistency, while the needs of the individual case are met, or at least should be, by the judgement of those charged with calculating the sum to be paid out.

The guidelines can be said to be all-encompassing. Particular sums are recommended for: head injuries, such as brain damage and epilepsy; psychiatric damage, such as PTSD or chronic pain; injuries affecting the senses, such as deafness or blindness; injuries to internal organs, such as asthma or mesothelioma; orthopaedic injuries, such as vibration white finger or back injuries; facial injuries; and, a range of other compensable personal injury conditions, such as dermatitis.

How much is your claim worth?
As well as being of use to legal professionals, the JSB guidelines can also be a helpful tool for claimants.

The first question many claimants are likely to ask is, "How much is my claim worth?".

Although there will be no definitive answer to this question until a case has been settled, what the JSB guidelines can do is help claimants get a general idea of what they might be entitled to.
