Modern lorries, vans and similar work vehicles are as comfortable and easy to drive as a private car and, apart from the largest HGV, most do not require a special licence or training to do so, however, if a fellow worker is being carried alongside the driver and there is an accident, the victim may be entitled to make a passenger compensation claim.
Given the amount of traffic on our roads, a crash is just as likely to occur between a commercial vehicle and a car as any other, although, given the relative size of a lorry and a car, the potential for injury is more likely to affect a car passenger than anyone sitting in the cab of a truck.
However, vans are a different matter, with many being no larger or sturdier than a car. Their main use is the ability to carry a load of awkward or heavy material for delivery from one place to another.
Ranging in size from sandwich and mail vans to larger ones used for refrigerated supermarket deliveries and the white van man with a reputation for poor driving up to removal pantechnicons capable of carrying a house-full of furniture, there is a van for every purpose out on our roads every day.
All of them have space for one or two passengers alongside the driver and, usually, they will be working together, loading and unloading or travelling to a place of employment with their tools. The passenger/workers have a right to be protected from any harm caused to them by the driver or other road-user in the same way as an accident victim in a private car.
If a vehicle accident occurs and the driver of the van is at fault, depending on the circumstances, the victim may be able to claim compensation either against the driver or against their employer because it may be termed a work-related accident.
The driver of a van belonging to an employer has the usual unwritten duty of care to other road-users which is a condition of him being granted a licence to drive but if an accident in a company-owned vehicle is a result of lack of maintenance by the employer then it must also bear some responsibility for the consequences of an accident.
Passengers must also take some care of themselves and not cause unnecessary risk to their own safety or that of the driver. Seat belts should always be worn and there should be no interference by the passengers with the driver's actions.
