Train accident compensation for Herefordshire train crash victims

Thankfully as train crashes are relatively rare, so are train accident compensation claims. However, when accidents do occur, they often result in multiple casualties suffering from severe personal injuries. While little can compensate for the suffering that such a tragedy can cause, a compensation claim can help ensure that survivors and relatives gain the necessary support they need to deal with such a disaster.

Train crashes can be caused by all kinds of reasons from faulty engineering in the train itself to driver error or signal failure. Level crossings also pose a danger to both trains and motorists as if the barriers fail or a driver decides to 'jump' the lights, the consequences can be devastating.

The incident at a Herefordshire level crossing in January 2010 only too clearly highlights how tragic the consequences of a train crash at a level crossing can be. After the lights and barriers at the level crossing in Moreton-on-Lugg failed, two cars went to cross the train tracks when their car was hit by a passing train.

A 52-year-old woman was killed in the crash when the train hit the car she was a passenger in. Her husband, who was driving the car, was left with serious pelvis and shoulder injuries and two other people in the second car were treated for minor injuries. The train driver along with several train passengers were also treated for shock.

Following the train accident, the line between Hereford and Shrewsbury remained closed for several days while the British transport Police and the Rail Accident Investigation Branch investigated the incident.

In a statement the deceased's family said that she would be greatly missed and described her as a "happy and generous person."

It is unknown if the injured or relatives of the deceased made a compensation claim for their personal injuries. However given the circumstances surrounding the accident, it is likely that compensation could be gained from Network Rail for the barrier's failure.
