Many people who do not possess their own vehicle, or are visiting an area to which they have not brought their car, rely on taxis to get from one point to another. However, some passengers using these services may be unfortunate enough to suffer a taxi crash.
When an individual experiences a road traffic accident they may be able to claim compensation for personal injury, suffering and loss of earnings, however, who they claim from is dependant upon who caused the incident.
In passenger injury cases a victim will only be able to make a claim against the person who is found liable for the taxi crash, and this may not necessarily be the taxi driver or cab company owner.
For example, if an accident occurred subsequent to another driver ignoring a red light and colliding with a taxi crossing a junction, then police investigations into the event may uncover that the taxi driver was driving in a safe and responsible way, and it was in fact the other motorist involved who was driving dangerously.
In this case the taxi driver could also take legal action against the other party for personal injury, and loss of earnings.
In other circumstances it might be a taxi driver's own reckless driving which results in a crash. In a hurry to take on board another fare and earn as much money as they can during a shift, some taxi drivers may occasionally go over the speed limit or undertake dangerous manoeuvres in an attempt to reach their customer's destination more quickly.
While their urgency may be understandable, since they must support themselves and maintain their car with the money they make each day, driving in such a manner increases the risk of a taxi crash and passenger injury occurring. All motorists should drive in a way which keeps them safe and is respectful of other road users, as is stated in The Highway Code.
Occasionally the court will find both drivers partly responsible for a road incident, and so liability will be spilt between them. If, for example the taxi driver is found 70% liable and the other road user 30% liable, then the passenger who was injured in the accident may find that a court rules for both parties to compensate them.
