Operator's licences to prevent a taxi crash

In the event of a taxi crash it may be possible for a passenger to claim personal injury compensation from either the driver's insurers or perhaps even the taxi firm which employs them. In 2009, a taxi firm from Chorley had its operator's licence revoked after "appalling defects" were found in many of its vehicles. The operator appealed against the decision in 2010, but the judge dismissed the action.

Faults found in the firm's taxis included bald tyres, defective seat belts, faulty steering, and broken brake lights.

Councillor Eric Bell, Chorley Council's executive member who oversees the authority's licensing function, said, "As a council we have a responsibility to ensure that when you get in a taxi it's safe.

"Some of the defects found on the taxis were appalling and fell way short of the legal standards.

"We will continue to rigorously test taxis that are driven in the borough and we will continue to take taxis off the road if they are not safe for people to use."

It is possible that in the event of a taxi crash a passenger accident compensation claim could be lodged jointly against the taxi firm and the local authority if the council has not fulfilled its obligations to oversee the licensing of local firms.

In February 2010, the Department for Transport (DfT) published revised Best Practice Guidance for the issuing of Taxi and private hire vehicle (PHV) licenses to be used by local authorities in England and Wales.

In the Policy Justification statement the DfT says that "the aim of local authority licensing of the taxi and PHV trades is to protect the public".
