Despite a number of high-profile rail safety incidents in which injury to a passenger, or passengers, has attracted headlines, the railway network remains the UK's safest form of surface transport.
This is a truth that has been borne out by statistics in recent years. For example, the rail safety statistics for 2009 revealed that there had been a 15% reduction in the safety risk posed to passengers when compared to the previous year.
Naturally, this reduction in risk was reflected in a lower rate of "recorded injury to a passenger".
However, despite these improvements and the relative safety of rail, considerable challenges remain, although in most circumstances the challenges are posed by the kinds of behaviours for which rail operators would not normally be considered liable.
For example, between April 2009 and March 2010 49 people died as a result of trespassing on railway tracks, either being hit by trains or being electrocuted by live rails.
Network Rail's general area manager Mark Tarry comments, "Unlike cars, trains cannot swerve and can take the length of 20 football pitches to stop.
"Contact with electricity power lines and tracks can result in horrific injuries, burns or even death. We want to prevent such incidents and help young people find more rewarding and exciting ways to spend their free time."
YouClaim's no win, no fee passenger compensation spokesperson comments, "There are incidents for which injured passengers may be able to mount no win, no fee claims, for example, car accidents, train accidents and plane accidents.
"However, in incidents where an injured party's trespassing or breaking the law is seen to be a factor in him or her sustaining injury, it is only in exceptional circumstances that compensation can be claimed."
