Rickshaw passengers could claim taxi accident compensation

London Taxi Cab

When most people think of taxis, the usual image is of a black cab or similar car, but there are now a variety of other vehicles which ply for hire, including limousines, minibuses, bicycle rickshaws and horse-drawn carriages, and any of the drivers or operators of these might be liable for taxi accident compensation.

An unfortunate incident in Edinburgh in April 2010 highlighted the previously unrecognised danger of being a passenger in a pedal-powered rickshaw when its passenger fell and struck his head on the road, causing severe injuries.

These forms of taxi, also known as pedicabs, are moving from their origin in Asia and becoming more popular in tourist areas in the UK as a novel means of transport, but currently they require only a street traders' licence and there are no rules on safe driving or judging the ability of the driver as there is with a standard motorised taxi.

The Royal Society for the Prevention of Accidents (RoSPA) says that, to protect themselves from injury, it is important that passengers sit properly on the rickshaw seat.

In London, where there are a number of professional companies providing a service, particularly in the West End, the rickshaws are inspected regularly, have public liability insurance and usually have seat belts.

They travel slowly, at less than 10mph, usually only go short distances and can be a fun, an environmentally-friendly means of public transport, however, especially when they are in heavy traffic, both driver and passengers can be vulnerable to having an accident.

Should a road accident involving a rickshaw occur, depending on the circumstances, a personal injury claim for compensation could be made by a passenger who has suffered as a result of the action of others, either the rickshaw driver or another road user.
