Seat belts reduce injury in a taxi passenger accident

London Taxi Cab

Most people would agree it is a sensible safety precaution to use a seat belt when travelling in a motor vehicle and there has been a reduction in serious injuries, including those involving a taxi passenger accident, since a requirement to wear one was made law in 1983.

As with other vehicles, the driver of a taxi is responsible for ensuring his passengers are safe and secure while travelling with him but the passengers are also liable for their own care. It has been proved that a rear seat passenger who is not strapped in can cause injury to other people in the vehicle as well as themselves if they move in an uncontrolled manner as a result of a car crash.

The driver of a licensed taxi or private hire vehicle does not have to wear a seat belt while he is seeking a fare, answering a call for hire or carrying a paying passenger but when travelling to or from work or using the car for his own purposes, as a private person he is liable to abide by the law and wear a belt.

In September 2006, the law on children wearing seatbelts in cars, minibuses or coaches was made stricter, requiring passengers to be strapped in, using specific types of restraint depending on their size, and for public service vehicles to fit belts. However, this does not apply to licensed taxis or private hire vehicles.

Children under three years may travel in the back of a taxi if no child restraint is available. Youngsters up to 135cm in height may use an adult belt in the rear seats, rather than the child seat they would have to use in a private car.

Some taxi firms have realised that parents may prefer the reassurance of their children travelling with standard child seats and belts and will supply them on request, particularly for long journeys, such as to an airport.

As with other road traffic accidents, if a taxi is involved in a crash, depending on the circumstances, there may be justification for victims to make a personal injury claim for pain, suffering and loss of earnings.
