Car crash victims must be aware of time limits for passenger compensation claim

After a car crash in which personal injury has occurred, it is likely to be some time before victims recover sufficiently to consider if the circumstances justify making a driver or passenger compensation claim.

Depending on the seriousness of a road traffic accident, it may be many weeks or even months before a victim has recovered their health enough to think about responsibility and possible legal liability for their ensuing pain, suffering and loss of earnings.

The police will be involved if an accident has caused injury and when a prosecution of an errant driver is pending, it is not possible for a civil damages action to be pursued at the same time.

However, once a criminal court case has been concluded and someone has been found guilty of a charge, such as dangerous driving or driving without due care and attention, it will be much easier for injury victims of the accident to proceed with making a justified compensation claim.

In all civil liability cases, there is a three-year limit from the time of the incident during which a claim must be registered. An exception is where the victim is aged under 18 and in that situation the case must be started before they are aged 21.

To save child victims of vehicle accidents having to wait until they are 18 to be awarded compensation payments, one or both of their parents can make an application on their behalf.

This can be particularly important where injuries have been disabling and any sum of money won will be spent on providing better living conditions and other practical help for a young accident victim.

Items such as special beds and wheelchairs or technological aids can be provided, and a home adapted to be more suitable for the disabled person's needs or extra money to pay for carers could all be usefully funded from a compensation payout.

A child victim making a passenger injury claim may have to seek a settlement from a member of their own family – even a parent – but this should not prevent him or her from doing so. The claim will be handled by lawyers because the car driver's insurance company and often the person responsible for the accident will have nothing personally to do with the legal action.

In instances of serious injury it is important that compensation is sought, regardless of the identity of the driver at fault, because the financial consequences can make a huge difference to the quality of the life of the victim. Where a driver is found to be uninsured or cannot be identified, the Motor Insurers Bureau is usually able to take over responsibility for ensuring fair recompense.
