In order to be eligible to make a passenger compensation claim a victim does not necessarily need to be taking legal action against the driver of the vehicle they were in.
As long as the accident which resulted in personal injury was non-fault on the part of the passenger a casualty may decide to claim against the driver of the other vehicle, or vehicles, involved.
For example, if a car was in a collision with a bus filled with people and it was the car driver's recklessness which caused the incident, then any injured bus passengers should be entitled to claim damages from the insurers of the motorist responsible.
Injuries suffered could range from minor to very severe, and a serious crash could even result in fatalities, but in most circumstances passengers or their families should be able to receive a settlement for their pain, suffering and loss of earnings.
A passenger is likely to be ineligible for remuneration if they were largely or entirely responsible for an accident. One instance in which this could occur is if investigations and witness reports show that the passenger was deliberately distracting a driver.
Distracting behaviour is extremely dangerous and places the passenger, the driver, and all other road users and pedestrians around them at risk of severe injury or death.
A case such as this could potentially result in the driver making a claim against the passenger. Although the driver will have been at the wheel, if the passenger was an adult the driver is unlikely to be blamed for not having been able to keep them from acting in a reckless fashion.
It is possible however that if the passenger was the driver's child, any accident caused by the minor would be considered the fault of the responsible adult.
