Passenger claim after car crash should take account of pain

A car crash which results in personal injury can lead to years of pain and distress for those involved, and this factor should be taken into account by a solicitor who is acting in a passenger claim for compensation.

A survey by a researcher at the University of Aberdeen School of Medicine, published in March 2011, found that there was a correlation between people developing chronic widespread pain following a traumatic event, especially if this was sparked by a vehicle accident.

The incidence was particularly marked where the victims had existing poorer health or psychological issues prior to the accident.

The researcher suggested that further work should focus on the special aspects of a car accident which triggered the victims' reactions and contrasted with other events including other hospital treatments, such as surgery and child birth, which did not have such consequences.

Chronic widespread pain is defined as pain above and below the waist, or on both sides of the body, for three months or longer.

The study of pain and its importance in the wellbeing of patients has been given greater importance by the medical profession in recent years, with pain clinics being established in many hospitals in an attempt to alleviate symptoms which appear to have no specific cause.

The National Audit of Pain Services was initiated in 2010 to collect detailed data on pain services in the UK, with the aim of improving NHS aid for people affected by chronic pain and establishing a national collection system which will enable services to monitor performance, share data, feedback and consensus of interested parties.

The British Pain Society was founded in 1988 as a development of the Intractable Pain Society of Great Britain and Ireland and today its membership comprises doctors, nurses, physiotherapists, scientists, psychologists, occupational therapists and other healthcare professionals actively engaged in the diagnosis, and treatment, of pain, and in pain research, for the benefit of patients.

It aims to promote education, training, research and development in all fields of pain. It endeavours to increase both professional and public awareness of the prevalence of pain and the facilities that are available for its management.

Suffering a car accident can be traumatic for all concerned, especially where serious personal injury of a driver or passenger is involved, and if pain continues after the end of immediate medical treatment this can be sufficiently debilitating for a victim to be unable to resume normal life for a number of months or years.

Loss of earnings and reduction of social or family life as a result of a vehicle accident can be taken into account when an assessment of a damages claim is made, and an experienced personal injury lawyer will be able to advise on this when a compensation case is being made.
