Occasionally a passenger accident claim may arise not from the accident itself but from the care given at the scene of an incident.
In February 2010 an investigation was launched after a passenger fell between train carriages at a station in Birmingham.
An eye-witness claimed that the emergency treatment offered to the man who had fallen was hampered because train staff could not get into a first aid kit located in the adjacent carriage.
The witness maintained that the door to the first-aid cabinet could not be opened "because the lock mechanism was faulty". He said the situation was very frustrating because it was an emergency.
Paramedics arrived within ten minutes and treated the fallen passenger for a head injury. He was later taken to a local hospital.
A train company spokesperson commented that the senior conductor on board the train had responded immediately to the incident at the station and had called 999 to summon an ambulance.
He said, "We do have full first aid kits for these kinds of circumstances, which are inspected and checked on a regular basis. We take the safety of our passengers extremely seriously."
He added that the company were investigating the incident, but would not, at the time, comment on the allegations regarding the faulty first-aid cabinet.

If you are a paying customer of an airline, bus company or train service you should be able to expect that the firm will look after you in the event of an emergency if it is at all possible to do so.
Where first aid kits are provided they should be well-maintained and the transport company could be held liable if a fault with such equipment caused a delay in emergency treatment which later led to complications or permanent disability.
