Passenger compensation claims and vehicle overloading

Drivers have a responsibility not only to themselves and other road users but also to any passengers in the car – overloading a car can jeopardise the safety of all and may result in any injured passengers making a passenger compensation claim.

Unfortunately, the truth is that many drivers overload their vehicles without even realising they are doing so. However, being ignorant of the risks is no excuse in the eyes of the law and may result in fines and penalty points for offending drivers.

It is also worth considering that overloading a vehicle can lead to a driver's insurance cover being invalidated in the event of a car crash – although it is likely that the relevant insurance company will pay out for any third party injuries sustained in the incident, for example, a passenger compensation claim, it is under no obligation to do so for injuries sustained by the driver.

A spokesperson with AA insurance comments, "For instance, if the brakes aren't working properly or you roll the car on a bend although it's unlikely that an insurer will completely invalidate your cover under such circumstances, even though they would be within their rights to do so.

"It would have to be an extreme and blatant overloading of the vehicle to lead to an insurer refusing to pay the cost of your own damage (although they would still pay any damage to a third party). But they would certainly take the overloading into account in their settlement and increase your premium in future."

The holidays are the time when drivers are most likely to overload a vehicle. As well as the risks presented by loose objects inside a vehicle, there is also the effect that an overloaded vehicle can have on tyre pressure, springs, suspension and wheel bearings.

A spokesperson with Britannia Rescue advises, "To minimise the risk of breakdown and accidents, our advice is to take a little extra time before the journey starts to be sure your load is safe, secure, not blocking your view and within your car's maximum permitted weight."
