In the event of a plane crash, the Warsaw Convention is a central document to a compensation claim. However, it has been superseded in some respects by the Montreal Convention since the EU's ratification of the Convention in 2004.
This document, fully titled the Convention for the Unification of Certain Rules for International Carriage, was established in 1999 by members of the United Nations' International Civil Aviation Organization. Its most important provision for those considering a personal injury claim is that the amount of damages that an airline can be held liable for amounts up to approximately £100,000. (The exact figure is set to a benchmark that combines various currencies, and therefore varies.)
Aeroplane accident claims that involve larger amounts can be defended by the airline involved on the grounds that the company was not negligent, or that any negligence that had occurred was that of a third party. This does not necessarily mean that this will be a successful defence; a good personal injury solicitor should be able to advise a person who has suffered in a plane crash as to the strength of their claim.
Other provisions of the Convention demand that airlines have liability insurance, and set out appropriate levels for compensation claims regarding lost baggage.
