Charity minibus passengers can claim bus accident compensation

Many community charitable organisations rely on voluntary drivers of minibuses to be a transport lifeline for those without cars but, although they are not commercial businesses, the management of such groups is still responsible for any bus accident compensation if passengers are hurt.

Standard bus and coach operating companies have many rules and regulations with which they have to comply in order to carry passengers safely and charge reasonable fares for their services.

Drivers have to hold passenger service licences and the vehicles are regularly checked. However, minibus permits allow some organisations to carry fare-paying passengers without meeting the full requirements and without the drivers having to pass a special test.

Indeed, anyone who passed their driving test before January 1, 1997, and over-21s who passed after that date, is entitled to drive a minibus without any further training or licensing. A minibus permit is available from the Traffic Commissioners or certain bodies such as a local authority, some national charities and church organisations.

The permit allows for a vehicle which can carry between nine and 16 passengers, and the service cannot be for the general public. It is restricted to members of the designated community group and must be run on a not-for-profit basis.

Further information about minibus permits and community buses is available in the booklet Passenger Transport Provided by Voluntary Groups which is available from the Government's Vehicle Operator and Services Agency (VOSA).

All the public-spirited people who run such minibus community organisations and drive the vehicles have the best of motives in trying to help those who cannot drive themselves or have access to ordinary public transport to enhance their lives but, unfortunately, bus accidents can still happen.

If you are a passenger in a minibus which is in a vehicle crash and you suffer a personal injury which is not your fault you are likely to be entitled to make a passenger compensation claim against the organisation which runs the bus. Don't worry that you will be depriving the minibus group or charity of funds by asking for damages because it will have an insurance policy to meet such eventualities.
