Claiming damages following injury to a passenger

The Vehicle and Operator Services Agency sometimes carries out spot checks on taxis, unfortunately, these can sometimes raise worrying questions, such as whether flouting safety rules may lead to situations where injury to a passenger becomes an inevitability.

For example, in 2010 VOSA carried out spot checks on taxis and private hire vehicles operating in Peterborough.

Around 30 vehicles were inspected and, worryingly, four were found to have potentially dangerous mechanical faults. These included, steering faults, unroadworthy tyres and defective hand brakes.

Numerous other breaches were also recorded, including the absence of fire extinguishers (their presence is a legal requirement). In one case a driver was found to be operating despite having had his license revoked.

News of these failures led councillor Peter Hiller, Peterborough City Council cabinet member for Housing, Neighbourhoods and Planning to comment, "We will not tolerate illegal vehicles on the streets of Peterborough.

"They are potentially putting lives at risk. We have to ensure that members of the public can travel safely and we will continue to carry out these spot checks to ensure taxi drivers are keeping their vehicles up to standard, as well as working to regulations."

While Peterborough's Taxi enforcement officer warned that he would not tolerate companies risking injury to a passenger. "These operations are staged regularly without warning," he said.

"We found a number of vehicles with serious mechanical faults that put the drivers and public at risk.

"Public safety is our first concern and these operations send out a strong message to drivers that we will not tolerate regulations being flouted."
