Suffering an injury as a passenger and claiming compensation

The cold snap over the end of 2009 and beginning of 2010 left the country almost at a standstill as roads, runways and railway lines had to be closed due to the icy conditions. While most public transport was cancelled to prevent the risk of service users suffering an injury as a passenger, some private tour operators continued to run regardless of the risk.

On 23rd December 2009, an excursion to see some Christmas lights sadly ended in tragedy. The coach trip, mainly comprising of elderly passengers, was just returning from the excursion in Mousehole, west Cornwall when the crash occurred. The coach, carrying 48 passengers back from the trip, left the road and ended up on its side near Penzance. Nearly all of the passengers were injured in the crash, including five who were seriously injured and two elderly women who died from their injuries.

According to an onlooker, the bus driver managed to steer the vehicle between two trees as it slid on thick ice.

"There was no chance he could do anything but crash," the onlooker said.

"[The driver] did fantastically. He was very shaken. There was no way he could have done anything to avoid it. It was ice all the way down."

Officers attending the scene said that conditions were "treacherous" and had hampered rescue attempts.

Following the crash, questions were raised as to why Cornwall Council had failed to treat the steep hill where the accident happened and as to why organisers had decided to go ahead with the £8-a-head Christmas lights sightseeing tour especially as they were picking people up from remote spots.

Although no reports of compensation claims following the crash had been publicised at the time of writing, passengers that suffered personal injuries in the coach accident could well claim for personal injury compensation from the coach company.

While the bystander's reports seem to suggest that the driver did everything in his power to avoid the crash, the company's decision to proceed with the tour has been argued to have been an irresponsible one and could leave them open to negligence claims if they are found to be at fault.
