Injured passenger provisos for making a compensation claim

An injured passenger who has been involved in any kind of passenger transport accident should consult a compensation solicitor as soon as possible to see if they are eligible to make an accident claim against those who are deemed responsible.

In April 2010, 61 passengers on an American cruise liner were injured as a result of an emergency manoeuvre the ship was forced to make. Whilst most of the passenger injuries were minor and none required hospitalisation, passengers experienced a number of different problems as a result of the incident.

The ship had been carrying its 2,052 passengers through the Gulf of Mexico as it returned from a five day cruise. Unexpectedly the ship encountered a loose buoy, floating partly submerged, directly in its path. Reports issued by the cruise line company said that the buoy had not been picked up by radar equipment and the ship was forced to make a steering change which caused it to list by 12 degrees.

Passengers described falling out of their beds, sliding across decks on sun loungers, and crockery and glasses flying off tables.

One passenger described looking out of the window to see nothing but sky and many passengers felt the "list" was more like 30 degrees.

American holiday accident injury lawyer, Joseph Maus, drew passengers' attention to several pertinent clauses in the company's policy which would affect their claims for compensation.

He said that the company's Ticket Contract required full details of the cruise injury and accident to be received by them within 185 days of the injury, event, illness or death which gave rise to the claim.

In respect of cruise ship accidents, injured passengers must commence their proceedings within one year of the incident and served on the company within 120 days of the date of filing. The company in question also states that any lawsuit filed against them must be brought in the city where they have their headquarters.

This advice is useful for any injured passengers as checking the details of ticket terms and conditions may well save them costly errors when it comes to making a compensation claim.
