Can I claim compensation over a freight train crash?

Although most people will think of a train crash involving a passenger train, the rail network also operates freight trains, and these too can be involved in railway accidents.

There is, of course, much less likelihood of a passenger injury occurring where there are few or no passengers on the service, but the driver and any other staff required are still at risk of personal injury in a derailment.

Given that freight is often much heavier than passengers, the forces involved in such a crash can be higher, and there may be dangers related to the cargo - a 2009 train accident involving fuel oil, for example, caused a fireball that severely damaged a bridge, although the driver escaped without serious injury.

There is also the potential for a freight train to be involved in an accident with a passenger train if equipment fails, or if a freight derailment occurs where a passenger train may run into it.

If passengers are involved, the possibility of making a compensation claim for any personal injury suffered is similar to any other passenger injury claim. If, on the other hand, a sole driver suffers injury, he or she is more likely to consider a work accident claim.

In either case, it is likely that a claimant's personal injury lawyer will need to show that the train company is responsible for the accident; this may mean that the company had not provided appropriate safety equipment, had not maintained that equipment, or had failed to train the driver appropriately, for example.
