Compensation for moped accidents could be invalidated by drinking

Most of us are guilty of a 'holiday mentality' where we do things abroad that we perhaps would think twice about doing while in the UK. Drink driving is perhaps an extreme yet realistic example of this. As the drink drive laws can be more relaxed or less well policed abroad, many travellers and holiday makers are tempted to hire mopeds or motorbikes while under the influence of alcohol. Unfortunately, this leads to many crashes for which compensation for moped accidents is not viable.

The case of a British teenager who fell off the back of a moped in Greece is a good example of this.

While holiday-making in Crete, the British girl, who had been drinking, came off the back of a moped. As she had not been wearing a helmet, she sustained serious head injuries as well as injuries to other parts of her body.

After receiving treatment in a Greek hospital, the girl was to be transferred to a hospital back in the UK at a cost of £20,000. Due to her drinking, her insurance policy was invalidated and the family had to pay the cost of her transportation. They will also be unlikely to be able to make a compensation claim against the driver for the costs incurred from the crash because of alcohol consumption, so will have to fund the expenses themselves.

Unfortunately, this is not an isolated case as many holidaymakers tend to be more reckless and less responsible of their own welfare while abroad. Driving on unfamiliar roads with different regulations can cause confusion and accidents to the most sober driver. However, for a driver who has had a few to drink, the combination can be lethal.

It is therefore imperative that you never get on a moped, whether it's to drive or as a pillion passenger, after drinking. Paying for medical bills and any other losses without the chance of gaining any compensation is not something worth thinking about. Therefore, while you should still enjoy and make the most of any opportunities abroad, you should also take a moment to really think through why it is that you wouldn't undertake certain actions at home.
