Many people choose to use coaches in order to visit family members and reach holiday destinations throughout the UK. The majority of these people have a safe journey, however, there are some people who unfortunately experience personal injury during their trip and have to claim coach crash compensation.
It is the coach driver's responsibility to drive safely for the benefit of passengers and other road users. If the coach is involved in a road traffic accident and the coach driver is found to be at fault and therefore liable, any injured passengers may claim compensation for their pain, suffering and loss of earnings.
Seatbelts
Legislation has been passed by the Department for Transport, making it a legal requirement for any coaches made or used on the 1st October 2001 or after that date to have seat restraints for passengers. As a result, many coaches are now equipped with seatbelts, but coaches manufactured before 1st October 2001 may also still be functioning and as such, the legislation not having applied to them, they might not have safety restraints on board.
If the coach driver causes the vehicle to crash through negligence and dangerous driving, leading to passengers sustaining a personal injury, those not wearing seatbelts, if they were available, may find it difficult to make a successful coach crash compensation claim.
Although the coach driver should prompt passengers to use seatbelts at the beginning of the journey, their legal responsibility only rests with those individuals who are under 14 years of age. At 14 years and over, it is the responsibility of that individual to take the initiative and use the seatbelt provided, just as it is their responsibility in a car.
Large vehicles
Coaches are much larger vehicles than cars, vans and even some lorries and as such they may give a sense of security to those inside, but due to their height they can actually be more unstable on the roads should the driver turn abruptly (especially at speed) or should there be powerful winds. Coaches are not as aerodynamic as some other vehicles and fast-moving winds cannot move around them as easily as a car. The driver should take extra care in bad weather in order to decrease the risk of coach accident. By minimising speed drivers can lessen the effects of the wind's speed on their coach.
